I am in NYS and charge NYS Sales Tax.
ebay says
“In October 2018, we announced that several states passed laws requiring eBay, as well as other online marketplaces, to collect sales tax on taxable items mailed to addresses in those states. In such cases, eBay calculates, collects, and remits the sales tax on your behalf. We collect the sales tax at checkout and you do not need to take any action. We do not charge a fee for this function.”
Does this mean I no longer have to charge buyers sales tax and send it into NYS every year??
Anyone Know for sure?

If your state is not one of the states ebay is collecting and remitting for, then YES you have to collect sales tax in your own state.

“The California Department of Tax and Fee Administration (CDTFA) began drafting new regulations to implement the decision, which are to take effect April 1.
Meanwhile, state legislators and state Treasurer Fiona Ma are fast-tracking a bill that would impose a looser requirement, exempting smaller Internet retailers from collecting taxes. They hope to have it enacted by the April 1 deadline set by the CDTFA, thereby avoiding the confusion of having two different and conflicting tax-collection systems.
However it occurs, Californians will begin paying sales taxes on many, if not most, of the items they have been ordering via the Internet. And that means more money flowing into state and local government coffers…Much of the additional revenue would come from a provision in the bill that requires “marketplace facilitators” to collect taxes. Those are organizations, such as eBay, that don’t sell directly to customers but are marketplaces for sellers, much like updated, electronic versions of the old newspaper classified advertising sections.” Full Article

Hi Christine,
I met with my accountant here in the upper left (WA). She said wa state dept of revenue has been sending letters/tax bills to consumers who bought online last year in our state. Surprisingly with as much Amazon stuff mrs. big sally buys we’ve not got this letter. The accountant has advised folks, don’t pay it, due to some technical reason far above my pay grade. But our state is BIG on taxing everything-
Ebay is taking the tax for my washington sales now and remitting it directly. Which happens to be a lot this month as I scored some awesome vintage Rainier Beer Posters $$ 🙂

Hi Sally, I hope next year I’m out of the sales tax business altogether! I’m still wondering how Ebay will handle the change and if they will do it timely (in our State as of 4/1). Ebay is located here, so really they ought to be prepared. If Ebay doesn’t prompt, I’ll have to remember to shut off my collection setting.

I always collect Sales Tax for my State (Massachusetts) and file and send it in myself. I am such a small seller I only have to file once a year (undeer $100). When doing a new listing today I checked the link to “View Sales Tax Table” and Iowa, Minnesota and Washington all said something like: You no longer need to collect, Ebay will do it for you. MA is checked.
